The US state of New York has approved measures to prohibit the use of intentionally added per- and polyfluoroalkyl substances (PFAS) in firefighting personal protective equipment (FPPE), on May 9, 2025. Restrictions on the Sale and Use of Firefighting Equipment Containing PFAS Chemicals
Under New York’s General Business Law Section 391-U ‘Restrictions on the sale and use of firefighting equipment containing PFAS chemicals’, a manufacturer or other person selling FPPE must provide written notice to the purchaser at the time of sale if the FPPE contains PFAS chemicals. The notice must include a statement that the FPPE contains PFAS chemicals and an explanation of why they have been used.
Scope of Firefighting Personal Protective Equipment (FPPE)
FPPE means any clothing worn by firefighting personnel in the performance of their duties that are designed for use in firefighting and rescue activities, including:
- gloves
- helmets
- jackets
- pants
- respiratory equipment
- and shoes
Implementation Timeline
It is required that PFAS is prohibited if intentionally added, or if present above a threshold to be established by the Department of Environmental Conservation of the US.
The ban will become effective on January 1, 2028.
